PROP 65 EXEMPTION
Our company employs fewer than 10 full-time and part-time employees and is therefore exempt from California's Proposition 65 warning requirements under Health & Safety Code Section 25249.11(b). This statutory exemption applies directly to businesses like ours that do not meet the "person in the course of doing business" threshold, shielding us from obligations to provide chemical exposure warnings or face related enforcement actions. This means no Prop 65 labels are required on our products, even if they contain trace listed chemicals below safe harbor levels. All employee counts are based on the date of any potential exposure. To assure Californians are very aware of our stance and promises made to them, we also include "not prop 65 compliant" on our packaging, although we are not required to by law. Sorry Californians, you will have to look for someone else to sue...
We provide these heavy metal results to consumers as an act of good faith, transparency, and a warning to those who are sensitive to these metals. We're not required to publish these results or send these results to any consumer. We do so based on the fact we work very hard to source from low metal regions within Ecuador to make our products as safe as possible. We're proud of this work because it's meticulous, expensive to frequently test, and we communicate this priority consistently with our farmers that we need our metals as low as possible at all times for the safety of our customers.
These metal results in regards to PPM for our products are within federal recommendations, outside of Prop 65.
